Terms of Service

These Terms explain the rules for using Fundlyr’s intentional money organization tools, bank data connections, subscriptions, and account features.

1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Fundlyr, including our website, account dashboard, budgeting features, bank-sync features, support, and related services (collectively, the “Service”). Fundlyr is a product operated by DATAN3RD. References to “Fundlyr,” “we,” “us,” or “our” mean DATAN3RD as the company operating the Fundlyr product and Service.

By creating an account, starting a trial, connecting a bank account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, do not use Fundlyr. If you are using Fundlyr on behalf of another person or household, you confirm you have permission to do so.

2. What Fundlyr does

Fundlyr helps you understand cash flow by organizing balances, income, bills, spending categories, savings goals, and transaction activity into a clearer available-to-spend view. The Service is designed for personal or household budgeting and planning.

Fundlyr provides informational budgeting tools only. We do not provide financial, legal, tax, accounting, credit, debt, investment, or professional advice. You are responsible for your financial decisions, transfers, payments, purchases, and account reviews.

3. Eligibility and accounts

You must be able to form a binding contract and use the Service lawfully. You are responsible for providing accurate information, keeping your account details current, maintaining the confidentiality of your login credentials, and all activity that occurs under your account.

You agree not to share access in a way that creates security risk, impersonate another person, create accounts using false information, or attempt to bypass account, billing, or security controls.

4. Bank connections and financial data

Fundlyr may use authorized third-party data providers to connect to financial institutions. When you connect an account, you authorize Fundlyr and those providers to access, process, and display account information such as account names, balances, transactions, dates, categories, and related metadata so we can provide the Service.

Bank connections are intended to be read-only unless we clearly state otherwise. Financial institution data can be delayed, incomplete, duplicated, unavailable, pending, reclassified, or inaccurate. You should verify important balances, bills, due dates, and transactions directly with your financial institution before making financial decisions.

5. Budget calculations and accuracy

Available-to-spend amounts, envelope balances, paycheck allocations, goals, category matches, transaction suggestions, and similar outputs are estimates based on data available to Fundlyr and rules you create or approve. These calculations can be affected by pending transactions, bank sync timing, categorization choices, duplicate data, deleted accounts, or service interruptions.

You remain responsible for reviewing your financial accounts and deciding whether money is available to spend, save, transfer, or pay toward obligations.

6. Subscriptions, trials, and payments

Some Fundlyr features may require a paid subscription. Trial length, pricing, renewal timing, cancellation rules, taxes, and payment terms are shown during checkout or account management. Unless stated otherwise, subscriptions renew automatically until canceled.

Payments may be processed by third-party payment providers. You authorize us and our payment providers to charge your selected payment method for applicable fees. You can cancel according to the billing terms presented at purchase, but cancellation may not automatically provide a refund for past charges except where required by law or expressly stated by us.

7. Acceptable use

You may use Fundlyr only for lawful personal or household financial management. You may not misuse the Service, including by attempting unauthorized access, probing or bypassing security, scraping or harvesting data, reverse engineering, overloading infrastructure, uploading malicious code, interfering with other users, reselling the Service without permission, or using the Service for illegal or abusive activity.

8. Third-party services

Fundlyr may rely on third-party services for bank connectivity, payments, hosting, analytics, email delivery, authentication, security, or support. Third-party services may have their own terms and privacy practices. We are not responsible for third-party services that we do not control, but we choose providers to help operate Fundlyr responsibly.

9. Service changes and availability

We may modify, improve, suspend, or discontinue parts of the Service at any time. We work to keep Fundlyr reliable, but we do not guarantee uninterrupted availability, error-free operation, or that every bank, payment provider, device, browser, or feature will always work.

10. Termination

You may stop using Fundlyr at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to pay required fees, misused the Service, or if continued access would harm Fundlyr, other users, partners, or providers.

After termination, some information may be retained as described in our Privacy Policy for legal, billing, security, backup, or operational purposes.

11. Disclaimers

To the fullest extent permitted by law, Fundlyr is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Fundlyr and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, financial losses, overdraft fees, missed payments, or other losses arising from your use of or inability to use the Service.

To the fullest extent permitted by law, Fundlyr’s total liability for any claim relating to the Service is limited to the amount you paid to Fundlyr for the Service during the twelve months before the claim arose.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as by posting the updated Terms or sending an in-product or email notice. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
